TRANGOWORLD S.A., in compliance with article 97  and following of RD 1/2007 of 16 November, approving the consolidated text of the General Law for Protection of Consumers and Users, informs that this document establishes the Conditions governing the use of this website https://www.trangoworld.com.

Please read these Conditions, our Cookies Policy, our Privacy Policy and our Legal Notice.

The contract can be formalized, at your option, in any of the languages in which the Conditions are available on this website.

These General Conditions for Use and Contracting are written in the Spanish language.

In making use of this website, the user consents to the processing of said information and data and declares that all the information or data that are provided are true and correspond to reality.

TRANGOWORLD S.A. complies with the General Data Protection Regulation guidelines ((EU) Regulation 2016/679) and all other regulation in force at all times, and ensure the correct use and processing of the user’s personal data.

To this end, together with each personal data collection form, in the services that the user can request from Trangoworld S.A. , it will notify the user of the existence and acceptance of the specific conditions of the processing of their data in each case, informing them of the responsibility of the data file created, the address of the controller, the possibility of exercising their rights of access, rectification, cancellation or opposition, the purpose of the processing and the communication of data to third parties, as applicable.

Likewise, TRANGOWORLD S.A. creator of the website informs that it complies with Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce and requests from the user their consent to the processing of their e-mail for commercial purposes at all times.

MINORS

The contents of the Website are addressed to persons of legal age. TRANGOWORLD S.A. does not intend to obtain data from minors. When TRANGOWORLD S.A. is aware that there exist in its data file personal data of a minor, it will immediately proceed to cancel said data.

4. USER OBLIGATIONS

The user must at all times, respect the terms and conditions established by the website.

The user will use the website diligently and assuming any responsibility that may result from breaching the terms and conditions of the website.

The user cannot use the website to transmit, store, disseminate, promote or distribute data or contents that are carriers of virus or any other computer code, files or programs designed to interrupt, destroy or impair the operation of any program or computer or telecommunications equipment.

6. INDUSTRIAL AND INTELLECTUAL PROPERTY

TRANGOWORLD S.A. of itself or as assignee, is holder of all the intellectual and industrial property rights of its website, as well as of the elements contained in it (including images, sound, audio, video, software or texts; brands or logos, combinations of colours, structure and design, selection of materials used, computer programs necessary for operation, access and use, etc.), ownership of TRANGOWORLD S.A. or else of its licensors.

By virtue of the provisions in articles 8 and 32.1, second paragraph, of the Law on Intellectual Property, the reproduction, distribution and public communication are expressly prohibited, including its modality of making available of all or part of the content of this website, for commercial purposes, in any format and by any technical means, without the authorization of TRANGOWORLD S.A. All rights reserved.

The USER agrees to respect the Intellectual and Industrial Property rights owned by TRANGOWORLD S.A. and may view the elements of the portal and even print them, copy them and store them in the hard drive of their computer or in any other physical format as long as it its solely and exclusively for their personal and private use. The USER must abstain from deleting, altering, eluding or tampering with any protective device or security system that is installed in the pages of TRANGOWORLD S.A.

7. HOW TO PURCHASE OR MAKE ORDERS

There are two ways of making an order. One is as a registered user and another is as a guest.

7.1 PURCHASE AS A REGISTERED USER

In this case, it will be necessary to complete a form with the personal data of the user which will allow them to modify their data to have them updated, manage their purchases, track the shipments and enjoy promotions and special offers.

Before completing the registration, the user must obligatorily accept these general purchase conditions so that otherwise, the process will not have been completed and therefore, they may not acquire the condition of registered user with its associated advantages. Once the registration is completed, the user may access the private area as many times as desired by entering the personal user name and password.

7.2 PURCHASE AS A GUEST

The guest does not have the obligation to register but must provide their necessary personal data to carry out the shipment, and must in all cases accept these purchase conditions.

7.3 PURCHASING PROCESS

In both cases, the purchasing process is very simple, as the user only has to select the product/s he/she wishes to purchase and add it/them to the shopping cart. On selecting each product, the listed information about it is displayed:

• product characteristics
• colours available
• technical features, if any
• size guide
• price, including VAT but not shipping expenses, unless stated in the advertisement or according to the total purchase price.

To complete the purchase, the customer must go to the shopping cart, where the items selected and the shipping expenses are listed for review. At this time, if the customer has a promotion code or an online coupon to benefit from applicable conditions and discounts thereby indicated, it must be included; and he/she must accept the order. In the case of a user that has registered previously, they must identify and authenticate themselves with their user name (e-mail address) and password.

They must at this time indicate the shipping address, selecting it from the list of shipping addresses of their account or in the case of a guest, writing it again.

Once the order is reviewed and the customer is identified, payment must be made of the purchase, by credit or debit card or by PayPal. Any expense generated by the means of payment selected will be paid exclusively by the purchaser.

All payments made by credit or debit card will be made through the secure payment gateway of the Financial Entity, which encrypts the data of the cards. With the aim of providing maximum security to the system of payment, TRANGOWORLD S.A. uses the secure payment systems of BBVA. In this regard, the confidential data of the payment are transmitted directly and in encrypted form (SSL) to the corresponding financial entity.

When making the payment through the payment gateway, the system will connect to the bank that has issued the card, who will request authorization of the operation by a personal authentication code. The operation will only be performed if the bank that issued the credit card confirms the authentication code. Otherwise, the transaction will be rejected.

As an additional measure to the “Secure Payment” system and with the objective of collaborating in the prevention of fraud through Internet, TRANGOWORLD S.A. reserves the right to verify the personal data supplied by the customer and adopt the measures it deems appropriate (including the cancellation of the order) so that the goods acquired are delivered in accordance with the data stated in the order.

Once payment is validated, a purchase and sale contract is established between the user and TRANGOWORLD S.A. with these conditions. The only languages in which the purchases can be formalized will be Spanish and English, although, regardless of the language, the geographic area will be mainland Spain and Baleares.

Once the purchase process is completed, it will be confirmed by an e-mail of “Order confirmation” sent to the buyer that will contain the order number, number of items, description of each of them with their characteristics, sizes, price, taxes and shipping expenses as well as delivery period in the terms described in the shipments and returns section.

Failure to receive this message may be due to a transitory communications problem in the network or some error in writing of the e-mail address communicated. In both cases, it is advisable to contact us with the contact form (reason Order) to instruct you how to proceed.

7.4 MANAGEMENT OF "MY ACCOUNT"

In the section “My Account” the user will have at their disposal a complete space to register, modify or correct their personal data to have them updated, an address book to manage shipping addresses, billing addresses or of another type that may be of interest, list and proof of all orders made, wish lists (information regarding an article that may be of interest to you although you have not bought it), subscribe and unsubscribe from the informative newsletter, gift card in case of having one as well as other options that facilitate your management of user profile.

8. PRICES AND METHODS OF PAYMENT

8.1 PRICES

The prices advertised are valid except for typographical error or end of promotion. The prices published are expressed in Euros and include the Value Added Tax (VAT) and are valid for orders made within mainland Spain and the Balearic Islands.

The shipping costs of the products for delivery in mainland Spain and the Balearic Islands are added to the price of the product. Shipping will be free for orders of more than 100€.

TRANGOWORLD S.A. reserves the right to modify products, promotions, commercial conditions and prices at any time without prior notification to the customer.

8.2 METHODS OF PAYMENT

The products will be paid in advance with credit/debit card or PayPal.

8.2.1 Credit/debit card

Payment is accepted with all credit or debit cards and is made at the time of formalization of the purchase. This method is convenient and secure.

All the bank data relating to your card are requested in the 4B payment gateway of Banco Bilbao Vizcaya Argentaria, S.A. and https://www.trangoworld.com at no time has access to the confidential data of your card.

8.2.2 PayPal

If you wish, you can also pay for your purchase with the PayPal payment system with the conditions established by PayPal.

8.2.3 Bizum (available only in Spain)

You can also use your bank's Bizum payment app, if you have it available, with the conditions established by your bank.

9. DELIVERY PERIODS AND METHOD

The periods indicated below are computed from Monday to Friday and may be altered by local or national holidays.

On special days such as Christmas, Three Kings, long weekends or special promotions, we do not guarantee that the delivery will be made within a specific period, due to the volume of goods of the transport agencies.

Trangoworld reserves the right to modify the delivery periods and the type of shipment without prior notice in the case of orders of large dimensions (crashpads, etc...) or special cases.

Under no circumstances will shipments be made to post office boxes.

9.1 SHIPMENTS TO MAINLAND SPAIN AND THE BALEARIC ISLANDS

All shipments are made to domicile. For security reasons, shipments are not made for collection at Post Offices.

For security reasons no order will be accepted when it is not possible to identify the recipient of the order and their address.

All our orders reach their destination in 3 to 5 business days.

Free shipping for orders over 100€.

9.2 SHIPMENTS TO THE CANARY ISLANDS, CEUTA AND MELILLA.

For the moment, shipments are not made to the Canary Islands, Ceuta and Melilla.

9.3 SHIPMENTS TO INTERNATIONAL DESTINATIONS

For the moment, shipments are not made to international destinations.

9.4 CANCELLATION OF ORDERS

The orders that are confirmed and in phase of preparation cannot be cancelled. If you wish to cancel your order, you must contact our Customer Attention department with the contact form (reason Order) to indicate to you how to proceed.

10. RETURNS OF PRODUCT

If for any reason you are not satisfied with your order, you have a period of (30) calendar days from the delivery date of the order to return it.

The product must reach us in perfect condition, unused and in its original packaging, including guarantees, labels and instructions for use.

We will refund the amount of the returned items. The shipping costs will not be refunded since the delivery service has been correctly fulfilled.

To return the product you must log in to “My Account” and in the Orders section, choose the order, mark the items to be returned indicating the reason for the return in the drop-down menu.

If you do not have a user account, you can use the CONTACT form (reason Return) indicating the order number.

INSTRUCTIONS FOR RETURNING

Please follow the instructions below when packaging and sending your product to return it. It is important in order to correctly attend to your return, to follow these instructions.

1. Send the article in its original package
2. It is important that the products are perfectly packaged. In the event that the products are damaged due to inappropriate packaging, we will not accept return.
3. Include inside the package a copy of the order that you received on making the purchase or of the delivery note included in the box. It will not be possible to attend to the return of any article received in which this documentation is missing.
4. Go to the Post Office nearest you within the time limit and indicate your order number.
5. We will send an e-mail of confirmation when we have received the return in the warehouse and the refund has been authorized.
6. Once we receive the goods in our warehouses and we verify that all of the foregoing conditions have been met, trangoworld.com will accept the return of the product and will proceed to refund its price. The payment of the price will be made to the same credit/debit card or PayPal account used for payment.
7. The refund of the price to the user will be made in a maximum period of fifteen (15) days from receipt in our warehouse of the product of exchange or return. If the payment was made by credit/debit card it is probable that the bank will not show the amount of the refund in your balance until the following month.

trangoworld.com will not accept freight collect shipments; in case of any doubt, contact Customer Attention with the CONTACT form (reason Return) to indicate to you how to proceed.

11. RIGHT OF WITHDRAWAL

The right of withdrawal from a contract is the power of the consumer and user to leave null and void the contract entered into, thus notifying the other contracting party in the period established for the exercise of this right, without need to justify their decision and without penalty of any type. In short, it is the possibility to return the order without need for justification.

The product can be returned in a maximum period of thirty (30) calendar days from the day it was received.

The refund of the price will be made in a period of fifteen (15) calendar days from the date on which the decision of withdrawal from the contract has been effectively and unequivocally communicated, and always when the goods or products which are the object of withdrawal have been previously received.

The right of withdrawal will be made, sending to TRANGOWORLD S.A. through the contact e-mail (reason Return) the wish to exercise said right. Having received the communication, TRANGOWORLD S.A. will inform the customer of the steps and measures to be considered to carry out the right of withdrawal.

In this case, the cost of the return shipment is charged to the customer.

12. RIGHT OF EXCLUSION

TRANGOWORLD S.A. reserves the right to refuse or withdraw access to portal and/or the services offered without need for prior notice, at its own initiative or that of a third party, to those users who breach the Conditions of Use of the portal.

TRANGOWORLD S.A. will prosecute the breach of the Conditions of Use of the portal, as well as any undue use of its portal exercising all the civil and criminal actions that may correspond to it in law.

13. GUARANTEE

The products offered through https://www.trangoworld.com are subject to current legislation, which is established in article 116 of Royal legislative Decree 1/2007, of 16 November, approving the Consolidated Text of the General Law for Protection of Consumers and Users and other additional laws have a guarantee period established at two years from delivery.

Said guarantee will be applicable, except if. due to circumstances, it is not applicable, if the following conditions are fulfilled.: the product fits the description and possesses the qualities presented, it is suitable for ordinary use of products of its same type or for its special use if the manufacturer has accepted said use and it responds to the quality and features of products of its same type.

If any product is not in conformity with the foregoing conditions, the customer must communicate this by the contact form (reason After-sales/Guarantee).

14. MODIFICATIONS AND LINKS

TRANGOWORLD S.A. reserves the right to carry out, without prior notice, the modifications it deems appropriate on its website, and may change, delete or add both contents and services it provides as well as the way in which they are presented or localized, as well as in the General Contracting Conditions determined here.

TRANGOWORLD S.A. is not responsible for improper use made of the contents of its website, this being the exclusive responsibility of the person who accesses them or uses them.

In the event that on https://www.trangoworld.com links or hyperlinks are placed to other Internet sites, TRANGOWORLD S.A., creator of the website will not exercise any type of control over said sites and contents. Under no circumstances will TRANGOWORLD S.A. creator of the website, assume any responsibility for the contents of any link pertaining to an outside website, nor will it guarantee the technical availability, quality, reliability, accuracy, amplitude, veracity, validity and constitutionality of any material or information contained in any of said hyperlinks or other Internet sites. 15. APPLICABLE LAW AND COMPETENT JURISDICTION

The conditions for use of the Website contained in this document, as well as the relations between the user and TRANGOWORLD S.A., will be governed and interpreted according to Spanish laws. For the resolution of any dispute that may arise, the user and TRANGOWORLD S.A. expressly subject themselves to the competency and jurisdiction of the courts of the city of Zaragoza, expressly waiving any other jurisdiction to which they may be entitled.
